BINGO RULES
1. Eligibility. No person under the age of nineteen (19) years shall be permitted to participate in any game or games of bingo, nor shall any person under the age of nineteen (19) years be permitted to conduct or assist in the operation of any bingo game.
2. Rules Are Binding. Participation in any bingo game constitutes a Patron’s understanding of, and full and unconditional agreement to and acceptance of, these Official Rules as amended and revised.
3. Prizes. All prizes are subject to verification by Operator and compliance with these Official Rules. All taxes on prizes are Patron’s responsibility, with exception of taxes required to be withheld by law or due to the State of Alabama on winnings of $1200.00 or more. Patron may be required to supply Operator with proof of identity, age and taxpayer identification (social security) number to collect prizes. Patron is limited to the maximum payout listed on the subject bingo game and specifically agrees that Patron is not entitled to any winnings above the maximum listed payout on the subject bingo game.
4. Claims. Any Patron who believes they have a valid bingo pattern or jackpot not honored, or has any other dispute or complaint regarding any bingo game must immediately take the complaint, dispute or objection to the floor supervisor or manager on duty at the time. A written complaint form will be prepared and the matter investigated promptly by the Operator.
5. Publicity. By accepting any prize awarded in any bingo game, Patron agrees and hereby grants to Operator and its designees, including, but not limited to Operator’s affiliates, subsidiaries, related companies and/or advertising/promotional agencies, the right to use Patron’s name, biographical information (city and state or province), picture, portrait, voice, quotes, comments, image, and/or likeness for the purpose of advertising, trade or otherwise without further compensation, notification or consideration in any and all media now known or hereafter developed, in perpetuity.
6. Arbitration and Disputes. As a condition of participating in any bingo game, Patron agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with any bingo game, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action and exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Patron be permitted to obtain awards for, and Patron hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, out-of-pocket expenses and/or any other damages, and Patron further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Patron and Operator in connection with these bingo games, shall be governed by, and construed in accordance with, the laws of the State of Alabama, without giving effect to the conflict of laws rules thereof, and all proceedings shall take place in that State in the City of Dothan, County of Houston.
7. Limitations of Liability. Operator is not responsible and assumes no liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to its computers or servers. Operator is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, computer equipment or software. Any bingo machine malfunction voids all pays and plays for that Patron. Patron is limited to the maximum payout listed on the subject bingo game and specifically agrees that Patron is not entitled to any winnings above the maximum listed payout on the subject bingo game.
Operator is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by virus, tampering or hacking, or by any of the equipment or programming associated with or utilized in any bingo game. In no event will Operator, Houston Economic Development Association, or its affiliates, subsidiaries and related companies, their advertising or promotion agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, arising out of participation in any bingo game. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN ANY BINGO GAME IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
8. Disqualification. Operator, in its sole discretion, may disqualify any Patron from participating in any bingo game, and require the return of any prizes, if Patron engages in any conduct Operator deems to be improper, unfair or otherwise adverse to the operation of any bingo game or detrimental to other Patrons. Such improper conduct includes, but is not limited to, falsifying personal information required to claim prizes, or violating any term or condition of these Official Rules. The Operator reserves the right to refuse admission or service to anyone.
9. Severability. Should any section, clause or phrase of these Official Rules be for any reason held invalid by a court of competent jurisdiction, such decision(s) shall not affect the validity of the remaining portion of these rules.
10. Amendments/Revisions. Patron acknowledges that these rules may be amended or revised by the Operator without notice. The Official Rules are available at various locations throughout the Operator’s bingo games. By participating in any bingo game, Patron reaffirms that they are bound by the most recent version of the Official Rules.
